1. Agreement to Terms

By accessing or using Klau, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.

2. Description of Service

Klau provides a dispatch optimization platform specifically designed for roll-off container operations, including:

• Container-size based route optimization
• Drag-and-drop dispatch board interface
• Real-time job and driver management
• Print-ready dispatch sheets
• Performance analytics and reporting

3. SMS/Text Messaging Terms

As part of the Klau platform, we send SMS text messages to drivers and customers for operational notifications. By opting in to receive text messages, you agree to the following terms:

3.1 Types of Messages

You may receive the following types of text messages from Klau:

• Dispatch notifications: Job assignments, schedule changes, and route updates for drivers
• Order notifications: Delivery confirmations, pickup acknowledgments, and order status updates for customers
• Rental reminders: Rental expiry warnings and extension options
• Account notifications: Onboarding messages and service updates

3.2 Opting Out and Opting In

You can opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further texts will be sent. To opt back in, reply START to resume receiving messages.

3.4 Message Frequency and Rates

Message frequency varies based on your operational activity. Message and data rates may apply depending on your mobile carrier and plan. Klau does not charge for text messages, but your carrier may.

3.5 Carrier Liability

Carriers (e.g., T-Mobile, AT&T, Verizon) are not liable for delayed or undelivered messages. Message delivery is subject to network availability and device compatibility.

3.6 Privacy

Your phone number and messaging consent are handled in accordance with our Privacy Policy. We do not share your text messaging opt-in data or consent with third parties.

4. User Accounts

4.1 Account Creation

To use Klau, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Types

• Free Tier: Limited to teams with fewer than 5 trucks
• Paid Tiers: For operations with 5+ trucks, with varying feature access
• Demo Accounts: Temporary accounts for evaluation purposes

4.3 Account Termination

You may terminate your account at any time. We may terminate or suspend your account for violations of these terms, illegal activity, or non-payment of fees.

6.1 Your Data

You retain ownership of all data you input into Klau, including customer information, job details, and operational data. You are responsible for ensuring you have the right to use and process this data.

6.2 Our Data

We retain ownership of our algorithms, optimization logic, platform code, and aggregated anonymized analytics data. This data helps us improve our services and develop new features.

6.3 Data Processing

By using Klau, you grant us permission to process your data solely for providing the service and improving our platform. We will never sell your data to third parties. See our Privacy Policy for detailed information.

7. Payment Terms

7.1 Billing

Fees are billed monthly in advance. You are responsible for all applicable taxes. We may change pricing with 30 days notice. Your subscription will automatically renew unless cancelled.

7.2 Refunds

We offer a 30-day money-back guarantee for paid subscriptions. Refunds are processed within 5-10 business days.

8. Service Availability

8.1 Uptime Commitment

We strive for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance.

8.2 Service Changes

We may modify or discontinue features with reasonable notice. Critical changes that affect your core usage will include migration support.

9. Intellectual Property

Klau and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. Our algorithms and optimization logic are proprietary and confidential.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of Klau or violation of these terms.

12. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use Klau ceases immediately. We will provide reasonable assistance to export your data before account deletion.

13. Governing Law

These terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the state or federal courts located in San Luis Obispo County, California.

14. Changes to Terms

We may update these terms with reasonable notice. Continued use of Klau after changes constitutes acceptance of the new terms. Major changes will be communicated via email and platform notifications.
